My husband moved out but wants the house and kids?

My husband moved out; but wants the house and kids, who are 14 and 16. He feels they would be better of with him because he makes more $$, (all under the table), and as older boys they don't need me anymore. I would like to stay in the house with our boys but make little $$. we have no mortgage. no major bills except, phone, electric, internet, car insurance.????
He will try to make me out to be negligent because I drink wine with my girl friends on the weekends??
I would like joint custody. I am asking to stay in the house until my youngest is 18 then sell, or figure out a way to bey him out.

Drinking wine on the weekends with your girl friends is not negligence. Your husband will look like a fool to the judge.

What YOU need to do is to talk with a lawyer for one hour. Then go home and think about what the lawyer has said. It will cost money, yes, but it will be the best money you have ever spent.

As for him making more money, he can't use THAT as an excuse to take the kids .. the court will say, "Well, then you afford to pay LOTS of child support, can't you?"

He wants the house and kids? He can dream all he want. But you may have to buy out his share in the house once the kids are done their schooling. The kids get a free ride until they are done their schooling, but the wife doesn't. The husband is only obligated to help support the kids.
